This document provides detailed terms for the protection of the customer's personal data and is an extension of the store's regulations on the issue of privacy policy.

Online store activesquare.eu makes every effort to protect the privacy of those using the site.

2.WHO IS THE ADMINISTRATOR OF YOUR PERSONAL DATA AND HOW YOU CAN CONTACT US?

The company Activesquare Sp. z o.o. (reffered to asACTIVESQUARE)is the administrator of your personal data in connection with your use of the Website.

3.WHAT PERSONAL DATA DO WE PROCESS, FOR WHAT PURPOSES AND ON WHAT LEGAL BASIS?

As we provide different services to Users and non-logged-in Users, we process your personal data for different purposes, to different extents, and on different legal grounds as defined in the GDPR. To provide you with the clearest possible information, we have grouped this information by referring to the purpose of processing your personal data.

  • Data necessary for the realization of the order not requiring consent, but requiring confirmation of the Terms and Conditions

Data necessary for us to perform the service of order realization. For this purpose we process personal data provided by you in the shopping form for the Website, that is: name, surname, address, telephone, e-mail address

  • Services that do not require the creation of an Account, but require consent

We process your personal data to provide services that do not require the creation of an account but require consent: newsletter sign-up. Your data may be transferred to thirdparties to perform a marketing service

 

- Newsletter -We use the email address provided by the user to send the newsletter. We send newsletter only to users who have given their consent.

 

Legal basis. Necessity for the performance of the contract for the provision of electronic services (Article 6(1)(b) GDPR).

Filling in the data in the order form is equivalent to consent to the processing of the Orderer's personal data by Activesquare Sp. z o.o. (in accordance with the Act of August 29, 1997 on the protection of personal data, Journal of Laws. No. 133, item 883.). The Ordering Party's personal data will be processed exclusively for the purpose of fulfilling the order placed, including invoicing and financial reporting, as well as informing customers about new products and promotions in the Activesquare Sp. z o.o. online store, if the Ordering Party agrees. The data is confidential and will not be revealed to third parties.

4.TO WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

We transfer your personal data to the following categories of recipients:

Service providers

We transfer your personal data to the service providers we use to operate the Website. The service providers to whom we transfer your personal data, depending on the contractual arrangements and circumstances, are either subject to our instructions as to the purposes and means of processing such data (processors) or determine the purposes and means of processing themselves ( administrators). List of providers we use: data necessary for transactions and shipments: DPD, PocztaPolska, Przelewy24, Alior Bank, Google

Our suppliers are mainly based in Poland and other countries in the European Economic Area (EEA), such as Ireland.

You have the right to request that we provide you with a copy of the standard terms and conditions by directing your request as indicated in Section 2 of the Privacy Policy.

Public authorities

We share your personal data if we are requested to do so by authorized public authorities particularly the Public Prosecutor's Office, the Police, the General Inspector of Personal Data Protection (in the future the President of the Office of Personal Data Protection), the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications.

5. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

  • Online Store

Your provision of personal data is voluntary but necessary for the fulfillment of your orders. Your personal data will be processed by the Online Store until the expiration of the period of limitation of any mutual claims related to the implementation of contracts concluded with you.

6. WHAT ARE YOUR RIGHTS IN RELATION TO THE PROCESSING OF YOUR PERSONAL DATA?

We ensure the execution of your rights indicated below. You can implement your rights by making a request on the contact form.

Right to withdraw consent

You have the right to withdraw any consent you have given at the time of registration to the Website, as well as when using specific services and functionalities offered on the Website. Withdrawal of consent has effect from the moment of withdrawal. Withdrawal of consent does not affect processing performed by us lawfully before its withdrawal.

Withdrawal of consent does not result in any negative consequences for you. However, it may prevent you from continuing to use services or functionalities that we can legally provide only with consent (e.g. Profile Sharing).

The right to object against the use of your data

You have the right to object at any time to the use of your personal data, including profiling, if we process your data based on our legally legitimate interests, e.g. in connection with using the marketing of our products and services and our customers, keeping statistics on the use of specific functionalities of the Websites and facilitating the use of the Websites, and satisfaction surveys.

If your objection proves to be valid and we have no other legal basis for processing your personal data, we will delete your data against the use of which you have objected.

The right to delete data (“right to be forgotten”)

You have the right to request removal of all or some of your personal data.

You have the right to request deletion of your personal data if:

  1. you have withdrawn specific consent, to the extent that personal data was processed based on your consent;
  2. Your personal data is no longer necessary for the purposes for which it was collected or for which it was processed;
  3. You have objected against the use of your data for marketing purposes;
  4. You objected against the use of your data for Website usage statistics and satisfaction surveys, and the objection was found to be valid;
  5. Your personal data is being processed illegally.

Despite a request for deletion of personal data, due to an objection or withdrawal of consent, we may retain certain personal data to the extent necessary for the purposes of establishing, asserting or defense of claims. This applies specifically to personal data including: first name, last name, and data necessary for order processing, which we retain for the purposes of investigating complaints and claims related to the use of our services.

The right to restrict data processing

You have the right to request a restriction of the processing of your personal data. If you make such a request, we will prevent you from using certain functionalities or services, the use of which will involve the processing of the data covered by the request, until the request is processed. We also will not send you any communications, including marketing communications.

You have the right to request restrictions on the use of your personal data in the following cases:

  1. when you are questioning the accuracy of your personal data - in that case we will restrict the use of your personal data for the time we need to verify the accuracy of your data, but no longer than 7 days;
  2. when the processing of your data is illegal, and instead of deleting the data you request a restriction on its use;
  3. When your personal data is no longer necessary for the purposes for which it was collected or used by us, but is needed by you to establish, assert or defend your claims;
  4. when you have objected to the use of your data - in that case the restriction is for the time needed to consider whether - due to your particular situation - the protection of your interests, rights and freedoms outweighs the interests we pursue by processing your personal data.

The right of access to data

You have the right to obtain confirmation from us as to whether we are processing your personal data, and if we are, you have the right:

  1. gain access to your personal data;
  2. obtain information about the purposes of the processing, the categories of the processed personal data, the recipients or categories of recipients of this data, the intended period of storage of your data or the criteria for determining this period, your rights under the GDPR and your right to file a complaint with a supervisory authority, the source of this data, the automated decision-making, including profiling, and the safeguards applied in connection with the transfer of this data outside the European Union;
  3. obtain a copy of your personal data.

The right to rectify data

You have the right to correct and complete the personal information you have provided.With regards to other personal data, you have the right to request us to rectify this data (if it is incorrect) and to complete it (if it is incomplete).

The right to data portability

You have the right to receive your personal data that you have provided to us and then send it to another personal data administrator of your choice, such as another operator of similar Websites. You also have the right to request personal data to be sent by us directly to such other administrator, if technically possible.

At what time do we fulfill your request?

If in the execution of the above-mentioned rights you make a request to us, we will either fulfill the request or refuse to fulfill it immediately, but no longer than within one month after receiving it. However, if - due to the complexity of the request or the number of requests - we are unable to fulfill your request within one month, we will fulfill it within another two months informing you in advance of the intended extension of the deadline.

For technical reasons, we always need 24 hours to update your selected settings in our systems. Therefore, it may happen that you will receive an email from us during the systems update, from which you have resigned.

Reporting complaints, questions and requests

You may submit complaints, questions and requests to us regarding the processing of your personal data and the exercise of your rights.

If you believe that your data protection rights or other rights granted to you under the GDPR have been violated, you have the right to file a complaint with the Inspector General for Personal Data Protection (in the future, the President of the Office for Personal Data Protection).

7. HOW DO WE KEEP YOUR PERSONAL INFORMATION SAFE?

We make every effort to ensure the security of your personal information. The Website is using encrypted data transmission (SSL).

8. HOW DO WE USE COOKIES?

This website is using cookie files.

The online store does not automatically collect any data, except for the data contained in cookies during the use of the Website itself.

You can withdraw your consents to the use of specific categories of cookies in the Cookies Policy section.
