1.INTRODUCTORY REGULATIONS

Terms and Conditions define the rules for the use of the online store available at the following address https://activesquare.eu   The store is run by the company Activesquare Sp. z o.o headquartered in Żyraków 186, 39-204 Żyraków, registered in the National Court Register - XII Economic Department of the District Court for the city of Debica - under the number KRS 0001006613, NIP 872 244 0155

Terms and Conditions are publicly available and can be downloaded at any time. The Terms and Conditions are the regulations referred to in Article 8 of the Law on Providing Electronic Services.

2. GENERAL STATEMENTS

These Terms and Conditions define the rules for the use of the online store https://activesquare.eu   and in particular the terms and conditions for placing orders electronically and the rules for concluding sales contracts using the services provided by the online store, methods of delivery, payment, conditions for returns, exchanges and product complaints.

The Customer is obligated to familiarize himself with the contents of these Terms and Conditions and is always bound by their statements at the time of ordering.

We reserve the right to change these Terms and Conditions at any time, if necessary, in urgent cases like legal changes or for technical reasons. Information about the change will be published each time on the website https://activesquare.eu  in the Terms and Conditions tab at least 14 days in advance. The customer must accept the new Terms and Conditions no later than in the day of ordering.

The online shop https://activesquare.eu  sells products in Poland and selected European countries.

3. THE RULES FOR MAKING PURCHASES

Purchases in the online store https://activesquare.eu  can only be made by adults. Registration within the online store is optional. The customer can place an order without registration at store, after reading and accepting these Terms and Conditions.

The condition for placing an order is to fill in the fields marked as mandatory, to agree to the processing of personal data for the purpose of carrying out the order and acceptance of these Terms and Conditions.

To place an order, you need to:

• select the product which you are ordering and then click on the ‘Add to basket’ button
• select a method of delivery and payment
• enter your personal details and the address to which the product will be delivered
• enter your invoicing details if different from your order receipt details
• click the ‘Order with obligation to pay’ button

Acceptance by the online shop https://activesquare.eu  of each order placed is confirmed by e-mail. The conclusion of the sales contract takes place when the order is entered into the shop's computer system, provided that the order complies with the Terms and Conditions.

The online shop accepts https://activesquare.eu  orders twenty-four hours a day, every day of the year. Orders placed on Sundays and official holidays will be processed on the first working day following the day on which the order was placed.

Placing an order is equivalent to authorizing the online shop to issue an invoice without the need to obtain a signature.

The customer declares that all data provided for the purchase of the product is correct, that he/she is authorized to use the credit card, account or other form of payment he/she is using, and that he/she has sufficient funds or appropriate credit facilities to cover the cost of the product order.

4. PAYMENT METHODS AND PRICES

You are given the following options to pay for your order in our shop:

Your credit card information is sent directly between you and the Credit Card Authorization Centre and is not shared. It is only known to the bank processing your transactions.

The prices displayed in the online shop https://activesquare.eu  are expressed in Polish zloty (PLN) and in Euro (EUR) and include VAT. Activesquare Sp. z o.o. reserves the right to change prices without prior notice, with the proviso that price changes do not apply to orders which are in the process of being processed. 

5. CONDITIONS FOR THE DELIVERY OF PRODUCTS

Orders are shipped via GLS, FEDEX, DPD, Inpost. All parcels are shipped immediately*, we do our best to deliver orders placed by 2 p.m on the same day. If you choose to pay by bank transfer, no later than 1 day after the payment is registered on your bank account. We will inform you by e-mail of any change in the status of your order.
The expected delivery time and cost are set out in the chart below, the prices shown are gross prices. If the Customer provides an incorrect or inaccurate address, we shall not be liable for any non-delivery or delayed delivery of the order item.
We ship to the following countries:

Once an order has been finally accepted, it can no longer be modified.
*Pre-order products will be shipped from 15/07/2024.

6. PROMOTIONS

The web shop may contain information about promotions. The rules of the promotions are regulated by separate Terms and Conditions located at the bottom of this page.

7. EXCHANGE, RETURNS AND WITHDRAWAL FROM THE CONTRACT

You may return a product that you do not like without specifying a reason within 14 days from the date of receiving the package. The goods should be unused, undamaged and properly packed. You must enclose the proof of purchase (VAT invoice) and the completed exchange/return form, which can be found in the package sent to you or at the bottom of this page. For reasons of parcel security and speed of delivery, we recommend sending the products back by parcel service or using the postal option ‘Shipping confirmation’ or ‘Registered Parcel’. The cost of shipping the product to us shall be covered by the customer, in the event of an exchange of goods the cost of re-dispatch to the customer shall be covered by Activesquare. We will replace the product immediately, no later than 5 working days after receipt of the package.

If the goods are returned, a refund will be made no later than 14 days after receiving the declaration of withdrawal. We Activesquare Sp. z o.o. reserve the right to withhold performance until the product is returned. We will refund the amount due to the account indicated on the return form.

In case of cancellation or resignation from the order and if the payment for the ordered item has been made in advance, Activesquare Sp. z o.o. will refund you the amount paid (or part of it, if the order is executed in part) in accordance with generally applicable law.

8. COMPLAINTS

We guarantee that the product you order will be delivered brand new and undamaged. If after receiving the ordered product you discover any defects in it, please inform us and send back the defective product. The costs of shipping the product to us shall be covered by the customer; in the event of an exchange of goods, the costs of re-dispatch to the customer shall be covered by the Activesquare. If you would like to make a complaint about a purchased product, please fill in the complaint form at the bottom of the page. The completed form and the proof of purchase should be sent to us at the following address:

For security reasons, please send packages with confirmation of receipt or using a parcel service. A complaint will be processed within a maximum of 14 days of receiving the goods by Activesquare Sp. z o.o.

If the complaint is considered in favour of the customer – Activesquare Sp. z o.o. will immediately replace the defective product with a defect-free one or remove the defect. It does not affect the possibility of the customer to make a declaration of price reduction or withdrawal from the contract. If it is not possible to replace the product, remove the defect or reduce the price, we will return the amount immediately to the account number indicated in the form. If the complaint is not accepted, the product will be sent back with an opinion as to whether the complaint is unjustified.

9. WARRANTY

The Vendor is obliged to remove product defects revealed within the guarantee period, which are caused by reasons lying on the side of the Vendor, as a result of reasons occurring in the production process, construction or reasons inherent in the material used for production, as well as other cases specified herein.
The Seller provides a guarantee period of 60 months* for private persons, 12 months for companies.
The start of the guarantee period is from the date of purchase of the product by the buyer.
*The period of 60 months is for selected parts of the product, please refer to the instructions enclosed with the product for details.

10. LIMITATION OF LIABILITY

Unless the law provides otherwise, the online shop https://activesquare.eu  will not be responsible for: loss of income, loss of actual or anticipated profits, loss of contracts, loss of opportunity to use money, loss of anticipated savings, loss of transactions, loss of time, loss of opportunity, loss of goodwill, loss of reputation, loss, destruction or damage of data or any indirect or consequential loss. Such liability is excluded regardless of whether the damage is foreseeable, known or expected.

11. PRIVACY POLICY

We protect your data from unauthorized access. Your order, personal data and payment information are protected by technical security systems and additional authorization processes. This applies to both the transfer of data and its storage on our servers.

If you consent to the processing of your personal data by the Activesquare Sp. z o.o. (in accordance with the Personal Data Protection Act of 29 August 1997, Dz. No. 133, item 883.) they will be processed exclusively for the purpose of fulfilling your order, including issuing an invoice and financial reporting. We encourage you to give additional consent to the processing of your personal data for marketing purposes, thanks to which you will be informed about new products, promotions and exclusive offers in our online shop. This data is confidential and will not be passed on, resold or lent to other persons or institutions for purposes other than for the processing of your order.

Access to personal data is provided only to the administrator of the online shop https://activesquare.eu

You have the right to access your data, to correct it and to request that it is no longer used.

12. FINAL STATEMENTS

In matters not covered by these Terms and Conditions, the regulations of the Civil Code and the Data Protection Act and the Consumer Rights Act of 30 May 2014 shall apply. Any disagreements related to the services provided by the Activesquare Sp. z o.o. under https://activesquare.eu  shall be determined by the court of general jurisdiction. A customer, who is a consumer, has the possibility to use the out-of-court procedure for handling complaints and pursuing claims before the Permanent Consumer Arbitration Court at the Voivodeship Inspector of Trade Inspection in Rzeszów. Information on how to access the above-mentioned procedure and dispute resolution procedures is available at the following address: www.uokik.gov.pl, in the ‘Consumer Dispute Resolution’ tab.

Users posting opinions containing content that is forbidden by law, vulgar, offensive, violating the rights of persons or entities or violating the rules of social coexistence may incur criminal or civil liability for their content. Additionally, any vulgar or offensive comments will be deleted by the administrator. Activesquare Sp. z o.o. reserves the right to remove vulgar and offensive content without notifying the user who made such a post.
